RULES
1. GENERAL PROVISIONS
Article 1
These rules determine the beneficiaries of holiday services, holiday activities, the price of renting holiday units and payment, use of holiday units, cancellation and early termination of holidays, the right to appeal and the loss of the right to vacation.
2. HOLIDAY OPERATIONS
Article 2
(1) The holiday activity is carried out within the company Miran Furlan s. p.
(2) Professional and administrative-technical works of holiday activity are performed by Miran Furlan s. p.
(3) Miran Furlan s. p. takes care of:
- economical management of the holiday unit,
- rental of holiday units to guests
maintaining an adequate level of quality of the holiday unit, and
- keeping records in the field of holiday activities.
3. HOLIDAY PRICES AND PAYMENT
Article 3
(1) Miran Furlan s. p. has a calculation of prices for overnight stays in a holiday unit ready from 1 June 2021 until cancellation and can be changed at any time if necessary.
(2) The price includes value added tax.
(3) The guest is obliged to pay the price of the holiday according to the pro forma invoice, before the start of the holiday.
(4) After the payment, Miran Furlan s. p. forms a voucher for the holiday in the holiday unit and all the necessary instructions on the use of the holiday unit. At the end of the holiday, the guest receives an invoice.
(5) In addition to the price of the holiday, the guest is obliged to pay the tourist tax and registration fee at the local reception.
4. PERFORMANCE OF HOLIDAY ACTIVITIES AND BENEFICIARIES
Article 4
(1) Holiday activities shall be carried out throughout the year, except at the time when maintenance work is being carried out in holiday units or normal use of the holiday unit is not possible.
5. CANCELLATION AND EARLY END OF HOLIDAY
Article 5
(1) The guest may cancel the accommodation at any time, obligatorily in writing, but depending on the time of cancellation, the guest bears various costs.
(2) Cancellation of the holiday at no cost by the guest is possible up to 5 days before the start of the holiday. If the guest cancels the accommodation from 5 days to 2 days before the start of the holiday, he pays 30% of the total price of the holiday. If the guest cancels from 2 days (48 hours) to 1 day (24 hours) or on the day of the start of the holiday or does not attend it, he pays 100% of the holiday price.
(3) In exceptional cases which the guest cannot influence or avoid, e.g. force majeure (accident, illness of members registered for vacation or death in the family) is only on the basis of official evidence. In this case, the guest is entitled to a refund of the full amount paid.
(4) If a holidaymaker whose holiday has already been paid for cannot attend, he may transfer his reservation to another holidaymaker, but must notify Miran Furlan s. p.
(5) If the guest terminates the holiday for any reason on his part or due to force majeure, without any reason on the part of Miran Furlan s. p. the professional service does not return the funds already paid for the holiday.
(6) Miran Furlan s. p. may cancel or require the guest to terminate the holiday early without having to reimburse him if, prior to or during the holiday, extraordinary circumstances occur which could not have been expected or avoided, but which would have occurred at the time the holiday was granted. for Miran Furlan s. p. a valid reason that the holiday would not have been granted if they had been granted at that time. In this case Miran Furlan s. p. reimburses the guest the funds paid for the holiday for all days when he was not able to spend his holidays in the holiday unit.
Article 6
(1) When using a holiday unit, the guest is obliged to strictly follow all received instructions and to use the assigned holiday unit with the care of a good host.
Article 7
(1) Smoking is strictly prohibited in the holiday unit. Animals are also prohibited in the holiday unit.
Article 8
(1) If the guest during the holiday finds an irregularity or defect in the holiday unit or in the common part, which prevents or restricts the use of the holiday unit or may cause major damage to the holiday unit, he is obliged to immediately inform Miran Furlan s. p.
Article 9
(1) The guest is responsible for all damage caused during his holiday in the holiday unit. Miran Furlan is obliged to inform Miran Furlan s. p. immediately. The costs of repairing the damage must be paid within the prescribed period after receipt of the request for reimbursement.
6. RIGHT TO COMPLAINT AND COMPLAINT
Article 10
(1) A holidaymaker may lodge a complaint relating to the use of a holiday unit.
(2) The reasoned complaint is addressed by the holidaymaker to Miran Furlan s. p. no later than 8 days after the end of the holiday. The complaint must be accompanied by appropriate evidence (eg photographs, etc.), which show the actual situation, and confirmation from the professional service on the report of the defect.
(3)The complaint is decided by Miran Furlan s. p.
(4) When identifying minor deficiencies (poor TV signal, poorly cleaned unit, etc.) that do not significantly affect the quality of living in the holiday unit, the professional service does not return the funds already paid for the holiday.
(5) Complaints submitted after the expiration of the 8-day period shall be recognized as late and shall be rejected.
8. LOSS OF RIGHT TO HOLIDAYS
Article 12
(1) A person loses the right to holiday for a period of three years if he or she or persons traveling with him:
- do not respect the house rules in the holiday unit or the wider complex (apartment block, holiday settlement) and disturb other guests with their behavior,
- do not leave the holiday unit in accordance with the instructions,
- intentionally or through gross negligence cause damage to the holiday unit itself or to the common parts,
- do not pay the costs of repairing the damage caused to the holiday unit or common parts within the required time limit,
- allow other persons to use the allocated holiday unit in their absence,
- arbitrarily change the allotted term or holiday unit,
- use the holiday unit without the knowledge of the professional service
- violate the prohibition referred to in Article 8 of these Rules.
